Preserved Right to Buy

To qualify for the Preserved Right to Buy you need to have spent a minimum of two years as a public sector tenant of one of the landlords listed in the booklet Thinking of Buying Your Home.

A hard copy of the booklet is available from your local Service Access Point and the Preserved Right to Buy/Right to acquire Office based at Merefield House, Castleford.

If you became a new tenant with WMDC on or after 18 January 2005, however, you will not qualify for the Preserved Right to Buy until you have held a public sector tenancy for at least five years.

You will not be eligible to claim the Preserved Right to Buy if you:
  • Are an undischarged bankrupt.
  • Have a bankruptcy petition pending against you.
  • Have made an arrangement with creditors and still owe them money.
  • If a court has made a possession order which says that you must leave your home.
  • A tied-tenant – for example, the property forms part of your job – such as school caretaker, warden and so on.
The maximum discount for the Yorkshire area for Preserved Right to Buy is £24,000.

You must be living in the property as your only or principal home.

Up to three family members may share your application to buy if they live at the property as their only or principal home and have done so for more than 12 months.

Certain properties are excluded from the Preserved Right to Buy scheme. These include sheltered housing properties and certain bungalows / ground floor flats.

You cannot apply to buy your home if it is scheduled for possible demolition.

New rules mean that a Preserved Right to Buy can be suspended or ended if you (or any of your household or visitors) is engaging in anti-social behaviour (or threatening to do so).
