Land issues
You can buy or rent land from Wakefield and District Housing (WDH), or apply for long-term right to use the land for a specific purpose (easement).
First, you need to write or apply to us using this form
identifying the land you require and telling us whether you want to buy, rent or obtain an easement. You should also describe what you
want to use the land for, and enclose a plan or sketch drawing of the area if possible. Send your letter to:

Buying land
There are certain types of land that WDH does not wish to sell. For example,
a green area or any area with trees, because WDH want to keep the environment pleasant for the people who live there.
Upon receipt of the completed form above and administration fee (currently £200 plus VAT) various internal
consultations are carried out. If WDH agrees in principle to the request to purchase, it will be valued and terms will be
issued. Please be aware that the administration fee is non-returnable, should the application not proceed for any reason.
As well as the administration fee and the cost of the land, you will need to pay a surveyors' fee (currently a
minimum of £300 plus VAT) for the valuation and other necessary work and a plan preparation fee of £125 plus VAT.
You will also need to pay WDH's legal fees incurred in drawing up the legal documents
(currently a minimum of £300 plus VAT).
Renting land (licences)
If you would like to rent a piece of land, WDH would consider entering into a licence agreement.
This may also be an option where you have applied to buy, but WDH have decided the land is not for sale.
A licence does not give you a legal interest in the land, but gives you the right to occupy it, generally on a short-term
or annual basis, paying rent yearly. The arrangement can be terminated either by yourself or WDH. The rental is
calculated dependant on the type of use and the size of land.
The process for renting land is the same as that for buying land (see above). The administration fee and plan
preparation fee are payable as above, however surveyors’ fees and legal fees are at a lower rate of £125 (plus VAT)
and £100 (plus VAT) respectively.
Land encroachments
Land encroachment occurs where land is fenced off without permission. WDH provides a service for everyone and fencing off our
property is not just illegal, it is unfair on the other residents we serve.
If you think someone might have extended their garden into WDH land, or fenced off an area of WDH land without permission,
please contact us immediately.
